1. Acceptance of terms
By accessing or using up4 (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
up4 provides uptime monitoring, status pages, incident management, and related services. We reserve the right to modify or discontinue features at any time.
3. User accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration.
4. Acceptable use
You agree not to use the Service for any unlawful purpose, to abuse or overload our infrastructure, or to interfere with other users’ access to the Service. Monitor only endpoints you own or are authorized to monitor.
Agency use. Monitoring assets that belong to your clients as part of your own services — maintenance retainers, white-label reports, client portals and status pages — is expressly permitted; the Agency plan exists for exactly this. The account holder remains our sole contract partner and is responsible for all activity, usage and payment under the account.
One organization per account. An account may only be operated by the single legal entity that holds it. Sharing or sub-renting account access to third parties outside your own organization is not permitted; read-oriented client access through portals, share links and status pages is unaffected.
Platform resale. Offering the Service itself as your own product — for example reselling monitoring capacity or building a competing service on our API — requires a separate written agreement. Talk to us; we are open to partner arrangements.
5. Data and privacy
Your use of the Service is also governed by our privacy policy.
6. Trial, billing and balance
Trial. New accounts receive a one-time starting credit with full feature access — no payment method is required. The credit is drawn down by usage and by the monthly minimum (see below), so it lasts about a month of light use. When the starting credit is used up, monitoring is paused — your account and data remain accessible, and monitoring resumes as soon as you top up a balance or subscribe to a plan. Data of paused accounts is retained for at least 30 days.
Prepaid balance. You can pay for the Service by topping up a prepaid balance (minimum top-up €10). Usage — checks, alert deliveries, published status pages and similar metered events — is deducted from the balance at the rates published on our pricing page. A monthly minimum charge (currently €3) applies to pay-as-you-go accounts: in any calendar month where your usage is below the minimum, the difference is deducted from your balance; months where your usage exceeds the minimum are charged for usage only. Top-ups are single-purpose credits for up4 services; VAT is charged at the time of purchase where applicable. Your balance does not expire before the statutory limitation period (three years from the end of the year of purchase, §195 BGB). If you delete your account, we refund any remaining topped-up balance on request; promotional and starting credits are excluded from refunds.
Subscriptions. Alternatively, you can subscribe to a monthly plan (Team or Agency) with a large included monthly check budget and custom status-page domains with SSL included. If you reach the included budget, your existing monitors keep running at full speed, but adding new monitors is paused until the next monthly reset or a plan upgrade. Subscriptions renew monthly and can be cancelled to the end of the billing period via the billing portal.
Payment processing & merchant of record. Payments are processed by Stripe.
Where a purchase is completed through Stripe Managed Payments, Stripe (operating as
“Link”) acts as the merchant of record for that transaction: Link is your seller
for the purchase, issues the receipt or invoice, and handles applicable taxes. Your card
statement will show LINK.COM* together with our descriptor. The monitoring
service itself is provided by us under these Terms.
No lock-in, no dunning. We never delete data because of an empty balance; we pause monitoring instead. Prices may change for future usage; the rates applicable to your usage are always the ones published at the time the usage occurs.
7. Limitation of liability
The Service is provided “as is” without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
8. Changes to terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
